1. Introduction
Welcome to Joseph Mayden Photography ("JMP", "we", "us", or "our"). By booking our photography services, you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using our services.
2. Services
JMP provides professional photography services, including but not limited to portrait sessions, event photography, and commercial photography. By booking our services, you agree to comply with these Terms and any other agreements that may govern the provision of our services.
3. Ownership and Usage Rights
Ownership: JMP retains all ownership rights to the photos and videos taken during our sessions. Clients do not own the photos or videos but are granted limited usage rights as described below.
Client Usage Rights: Clients are granted a non-exclusive, non-transferable right to use the photos and videos for personal, non-commercial purposes. This includes sharing on social media, printing for personal use, and displaying in private settings.
Printing and Digital Use Rights: Only the client of the gallery and JMP have the authority to provide printing and digital use rights. Clients may not sell, license, or distribute the photos or videos for commercial purposes without prior written consent from JMP.
Editing Restrictions: Clients are not permitted to edit, alter, or apply filters to the images provided by JMP. Any edits to photos must be requested directly from JMP.
4. Payment and Cancellation
Payment: Payment terms will be agreed upon at the time of booking. Full payment is required prior to the delivery of final images unless otherwise agreed.
Cancellation: Clients may cancel their booking up to 90 days before the scheduled session for a full refund.
Cancellations made after 90 days of the session may be subject to a cancellation fee.
Deposits are nonrefundable but may be applied to rebookings, all rebookings are based of JMP's availability.
5. Image Delivery and Editing
Image Delivery: Final images will be delivered in a digital format within the time frame spcified in the session discription, unless otherwise specified.
Editing: JMP will perform basic editing and retouching on all final images. Additional editing requests may incur extra charges.
6. Client Responsibilities
Cooperation: Clients must provide accurate information and cooperate with JMP to ensure a successful photo session.
Permissions: Clients are responsible for obtaining any necessary permissions for locations and individuals to be photographed.
Permits: Any permits required for the session(s) will be obtained by JMP and will be added to the final payment by the client.
7. Limitation of Liability
No Guarantees: While JMP strives to provide high-quality services, we do not guarantee any specific results from our photography sessions.
Liability: JMP's liability for any claim arising from the provision of services is limited to the amount paid by the client for the services.
8. Indemnification
Clients agree to indemnify and hold JMP harmless from any claims, damages, or expenses arising from their use of the photos and videos, including any unauthorized commercial use.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of [State/Country]. Any disputes arising from these Terms or our services will be resolved in the courts of [State/Country].
10. Changes to Terms
JMP reserves the right to modify these Terms at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the revised Terms.
